Binding Contractual Terms

By using the website xeve.ai (the “Website”), including all content available through the Website or by accessing any associated content such as email feeds, feeds through apps or other related services provided by xeve.ai, you signify that you have read and understood these Terms of Use (“TOU”), and that these TOU have the same force and effect as a signed agreement. The Service is provided by Jay Web Development & Services, with principal place of business at Daxerstr. 42a, 82140 Olching and tax-id 117/229/10534.

Service Description

The Service allows users to interact with videos of models using a chatbot. The actions of the models are pre-defined by the video material and hard coded. The basic Service is free, with additional features available through in-app purchases as described on our website.

Use of AI Chatbot

The Website provides access to an AI-powered chatbot. The responses generated by this AI are not human-generated and may be fictional, inaccurate, or inappropriate. You understand and agree that you use the chatbot at your own risk.

You agree not to use the chatbot to engage in or promote illegal, abusive, harmful, or deceptive activities, including but not limited to the spread of misinformation, harassment, or solicitation of unlawful content. We reserve the right to monitor usage and block or report abusive behavior.

User Eligibility

You affirm that you are more than 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, warranties, and indemnifications set forth in these TOU, and to abide by and comply with these TOU.

Use of the Service

Downloading or accessing any part of the Service indicates that you accept and agree to be bound by the TOU and consent to the terms described herein. If you do not accept these TOU, do not use the Website, and delete any downloaded applications immediately.

You agree not to use the Service in any way that promotes or facilitates human trafficking, sex trafficking, or physical abuse. We maintain strict policies prohibiting such use and reserve the right to take immediate action, including termination of access and reporting to relevant authorities.

We reserve the right to modify or discontinue the Service, temporarily or permanently, with or without notice to you. You agree that Jay Web Development & Services will not be liable to you or to any third party in the event that we exercise our right to modify or discontinue the Service.

Changes to Terms

We may change these TOU at any time. Please review the TOU each time you visit the Service. By using the Service, you agree to be bound by the most recent version of the TOU.

Privacy Policy

Our Privacy Policy describes the information Jay Web Development & Services collects when you and others use the Service. It also describes how Jay Web Development & Services uses and shares any personal information you share with it. By agreeing to these TOU, you are also consenting to our collection, use, and sharing of your personal information in accordance with our Privacy Policy.

Links to and From the Service

The Service may contain links to third-party websites and online services that are not owned or controlled by Jay Web Development & Services. Jay Web Development & Services has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or online services. You access and use these websites or online services solely at your own risk.

User Submissions

You may submit feedback, notes, text, graphics, photos, videos, material, information, comments, messages, ideas, concepts, know-how, techniques, or other communications you transmit, upload, or post to the Service (“User Submissions”). Except for any personal information we may collect from you pursuant to our Privacy Policy, User Submissions will be considered non-confidential and non-proprietary.

Subscriptions and Billing

Users may subscribe individually to each character or to multiple characters, or select a "Page Subscription" or "One-Time Payment" option.

Each subscription grants access to the specified characters or content for a 30-day (“monthly”) or 365-day ("yearly") period.

Subscriptions will renew automatically unless canceled before the next billing cycle.

If canceled, access remains active until the end of the paid period. No refunds are provided for unused time.

Charges are processed every 30 days or 365 days, which may differ slightly from calendar months.

Page Subscriptions

Users shown a Page Subscription model may choose between One Character, Three Characters, or All Characters.

If One or Three Characters is selected, the user may switch which characters are active for premium features once per day.

One-Time Payments

Users may also purchase access via a one-time payment. These payments grant full access to all characters for a fixed duration — either 30 days (monthly), 90 days (quarterly), or 365 days (yearly).

These payments are non-recurring. Access expires automatically at the end of the selected term unless the user chooses to renew manually.

Special Case: "One Character" or "Three Charaters" Subscriptions

If "One Character" or "Three Charaters" Subscription is selected, the user can choose for which character the subscription applies by clicking the "Choose this AI" button in the video. The Character can be unselected by clicking "My Chars" and then "Details" next to the character. Here, you can find a "unselect" Button. The chosen character can be changed (unselected) only once per day.

Disclaimer of Warranties and Limitation of Liability

The Service is provided on an “as is” and “as available” basis. Jay Web Development & Services and Google expressly disclaim all warranties, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Jay Web Development & Services and Google will not be liable for any damages of any kind arising from the use of the Service.

Intellectual Property

All content seen or experienced on the Service, including graphics, text, logos, and software are owned by or licensed to Jay Web Development & Services. Unauthorized use may violate copyright and trademark laws.

Termination of Account

We reserve the right to suspend or terminate your account at our sole discretion if:

• You violate our Terms & Conditions, Privacy Policy, or any other applicable policies.
• You engage in activities deemed unlawful, fraudulent, or harmful to our platform or other users.
• Payment for subscriptions is not completed or is reversed (in cases of chargebacks).
• Your account remains inactive for an extended period, as determined by us.

Voluntary Termination

You may terminate your account at any time by contacting our support team or using the account settings page. Please note that no refunds will be provided for unused subscription periods unless explicitly stated in our Refund Policy.

Effects of Termination

• Upon termination, your access to the platform and all subscribed characters will immediately cease.
• Any data or content associated with your account may be deleted permanently, unless required by law to retain such data.

If you believe your account has been terminated in error, you may contact our support team to appeal the decision.
