Binding Contractual Terms

By using the website xeve.ai (the “Website”), including all content available through the Website or by accessing any associated content such as email feeds, feeds through apps or other related services provided by xeve.ai, you signify that you have read and understood these Terms of Use (“TOU”), and that these TOU have the same force and effect as a signed agreement. The Service is provided by Jay Web Development & Services, with principal place of business at Daxerstraße, 82140 Olching and VAT ID DE452091141.

Service Description

The Service allows users to interact with videos of models using a chatbot. The actions of the models are pre-defined by the video material and hard coded. The basic Service is free, with additional features available through in-app purchases as described on our website.

Credits for Image and Video Generation

You can purchase credits to generate images or videos based on your own prompts or a provided reference image. The number of credits required for each generation is displayed on the "Generate" button before you proceed.

Credit purchases are non-refundable and expire one year after purchase. Generated videos remain the property of Jay Web Development & Services to the fullest extent permitted by law; your use is limited to the rights expressly granted in these Terms.

AI generation can produce varying outcomes; results may differ from your prompt, change over time, or contain unexpected artifacts. By using these features, you acknowledge and accept that variability.

Custom AI Character and Action Requests

You may purchase a custom AI character or custom AI action request based on your submitted description. These custom-creation purchases are one-time, non-refundable service purchases for review and production work and do not guarantee that a requested result will be created exactly as described.

We reserve the right, in our sole discretion, to refuse, cancel, or decline any custom request that violates applicable law, these Terms, our ethics or safety standards, or public morality, including any request involving minors or characters that could reasonably be interpreted as minors. In such cases, we may decline production entirely.

Estimated delivery times for approved custom requests are approximate only and may vary depending on complexity, queue length, and internal review requirements.

Use of AI Chatbot

The Website provides access to an AI-powered chatbot. The responses generated by this AI are not human-generated and may be fictional, inaccurate, or inappropriate. You understand and agree that you use the chatbot at your own risk.

You agree not to use the chatbot to engage in or promote illegal, abusive, harmful, or deceptive activities, including but not limited to the spread of misinformation, harassment, or solicitation of unlawful content. We reserve the right to monitor usage and block or report abusive behavior.

User Eligibility

You affirm that you are more than 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, warranties, and indemnifications set forth in these TOU, and to abide by and comply with these TOU.

Use of the Service

Downloading or accessing any part of the Service indicates that you accept and agree to be bound by the TOU and consent to the terms described herein. If you do not accept these TOU, do not use the Website, and delete any downloaded applications immediately.

You agree not to use the Service in any way that promotes or facilitates human trafficking, sex trafficking, or physical abuse. We enforce a zero-tolerance policy through proactive monitoring, dedicated escalation channels, and ongoing reviews of flagged activity.

Our safety program includes immediate suspension of suspected accounts, preservation of relevant records, cooperation with payment processors, and prompt reporting to and collaboration with appropriate law-enforcement and victim-support authorities. We also require all personnel with access to user data to complete regular safeguarding training. Violation of these policies will result in termination of access and any other remedial action we deem necessary.

We reserve the right to modify or discontinue the Service, temporarily or permanently, with or without notice to you. You agree that Jay Web Development & Services will not be liable to you or to any third party in the event that we exercise our right to modify or discontinue the Service.

Changes to Terms

We may change these TOU at any time. Please review the TOU each time you visit the Service. By using the Service, you agree to be bound by the most recent version of the TOU.

Privacy Policy

Our Privacy Policy describes the information Jay Web Development & Services collects when you and others use the Service. It also describes how Jay Web Development & Services uses and shares any personal information you share with it. By agreeing to these TOU, you are also consenting to our collection, use, and sharing of your personal information in accordance with our Privacy Policy.

Links to and From the Service

The Service may contain links to third-party websites and online services that are not owned or controlled by Jay Web Development & Services. Jay Web Development & Services has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or online services. You access and use these websites or online services solely at your own risk.

User Submissions

You may submit feedback, notes, text, graphics, photos, videos, material, information, comments, messages, ideas, concepts, know-how, techniques, or other communications you transmit, upload, or post to the Service (“User Submissions”). Except for any personal information we may collect from you pursuant to our Privacy Policy, User Submissions will be considered non-confidential and non-proprietary.

Generated Media and the Community Feed

The Service does not accept image or video uploads. Every image and video you generate is produced by us from material we provide — our characters, our reference images, and the actions, styles and text prompts offered in the generator (“Generated Media”). Generated Media is synthetic, does not depict a real person, and carries a machine-readable mark identifying it as AI-generated.

Generated Media may be shown in the public areas of the Service — in particular the community feed and the “User generated media” sections — so visitors can see what the Service produces. By generating media on the Service you grant Jay Web Development & Services a worldwide, non-exclusive, royalty-free, transferable and sublicensable right to host, store, reproduce, adapt (for example to create a still preview frame or a smaller version), publicly display and distribute that Generated Media in order to operate, showcase and promote the Service. This right does not oblige us to publish anything.

Publication is never automatic. Each item is reviewed individually before it can appear, and we may remove any item at any time. Published items are shown without your name, e-mail address, account identifier or any other detail that would connect them to you, and we never publish your chats, your prompts, or media you generated but did not unlock. If you do not want an item of your Generated Media to stay published, contact us through the “Reporting & Complaints” section below or the contact details above and we will remove it from the public areas of the Service. Removal there does not reach copies other visitors may already have saved.

Subscriptions and Billing

Users may subscribe individually to each character or to multiple characters, or select a "Page Subscription" or "One-Time Payment" option.

Each subscription grants access to the specified characters or content for a 30-day (“monthly”) or 365-day ("yearly") period.

Subscriptions will renew automatically unless canceled before the next billing cycle.

If canceled, access remains active until the end of the paid period. No refunds are provided for unused time.

Charges are processed every 30 days or 365 days, which may differ slightly from calendar months.

Composition of the Subscription Price

The price of a membership or character subscription is made up of two separately priced components:

• Included generation credits. Your subscription includes a fixed number of generation credits per billing period. They are credited to your account in full at the start of each billing period and can be used immediately and in their entirety from that moment. This component is supplied separately and is priced separately, at the per-credit price of our smallest credits package. The number of included credits is shown at checkout and in your order confirmation.
• Access. The remainder of the price is for continuous access to chat, video chat and the premium features of your subscription over the term you purchased. This component is supplied continuously over that term.

This split matters if you withdraw from the contract as an EU consumer and had expressly requested that we begin providing the service during the withdrawal period: the access component is then owed only in proportion to the days of the term that had elapsed, while the credits component is owed only for the included credits you had actually spent. Free credits — the welcome credits, the daily login credits and any free generation — are never charged, and separately purchased credit packages are not part of a subscription's price. A Lifetime membership has no term; how its access component is valued on a withdrawal is set out below, in the section on the Lifetime membership.

Page Subscriptions

Users shown a Page Subscription model may choose between One Character, Three Characters, or All Characters.

If One or Three Characters is selected, the user may switch which characters are active for premium features once per day.

One-Time Payments

Users may also purchase access via a one-time payment. These payments grant full access to all characters for a fixed duration — either 30 days (monthly), 90 days (quarterly), or 365 days (yearly). Where it is offered, a one-time payment can also buy a Lifetime membership; it has no fixed duration and is described in the next section.

These payments are non-recurring. Access expires automatically at the end of the selected term unless the user chooses to renew manually.

Lifetime Membership

Where a "Lifetime" membership is offered, it is bought with a single one-time payment. It gives you the same access as a membership for all characters, it does not renew and it is never charged again. "Lifetime" means the lifetime of the service, not your own: your access lasts for as long as we operate xeve.ai. It is not a promise to operate xeve.ai, a particular character or a particular feature indefinitely, and the rules on account termination in these Terms apply to it as they do to every other membership. A Lifetime membership is personal and cannot be transferred to another person or account.

A Lifetime membership includes the same number of generation credits per 30-day period as a recurring membership. If you stay away for a while, the credits of at most the two most recent periods are added when you return; credits of earlier unused periods lapse. Voice output and other computing-intensive features are included for ordinary personal use by one person. If the use of an account exceeds that by far over a longer period — in particular through automated or shared use — we may limit the voice output for that account to a reasonable level, and we will tell you by email before we do. Your access as such and the text chat are not affected by such a limit.

If you withdraw from a Lifetime membership as an EU consumer and had expressly requested that we begin providing the service during the withdrawal period, the access component cannot be measured against a term, because a Lifetime membership has none. Each day on which you had access is therefore valued at one thirtieth of the access component of the regular monthly membership price at the time of your purchase, and in total never at more than the access component you paid. The credits component is treated as described under "Composition of the Subscription Price".

Special Case: "One Character" or "Three Charaters" Subscriptions

If "One Character" or "Three Charaters" Subscription is selected, the user can choose for which character the subscription applies by clicking the "Choose this AI" button in the video. The Character can be unselected by clicking "My Chars" and then "Details" next to the character. Here, you can find a "unselect" Button. The chosen character can be changed (unselected) only once per day.

Disclaimer of Warranties and Limitation of Liability

The Service is provided on an “as is” and “as available” basis. Jay Web Development & Services and Google expressly disclaim all warranties, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Jay Web Development & Services and Google will not be liable for any damages of any kind arising from the use of the Service.

Intellectual Property

All content seen or experienced on the Service, including graphics, text, logos, and software are owned by or licensed to Jay Web Development & Services. Unauthorized use may violate copyright and trademark laws.

Termination of Account

We reserve the right to suspend or terminate your account at our sole discretion if:

• You violate our Terms & Conditions, Privacy Policy, or any other applicable policies.
• You engage in activities deemed unlawful, fraudulent, or harmful to our platform or other users.
• Payment for subscriptions is not completed or is reversed (in cases of chargebacks).
• Your account remains inactive for an extended period, as determined by us.

Voluntary Termination

You may terminate your account at any time by contacting our support team or using the account settings page. Please note that no refunds will be provided for unused subscription periods unless explicitly stated in our Refund Policy.

Effects of Termination

• Upon termination, your access to the platform and all subscribed characters will immediately cease.
• Any data or content associated with your account may be deleted permanently, unless required by law to retain such data.

If you believe your account has been terminated in error, you may contact our support team to appeal the decision.
